By accessing or using any part of the Merchievo.Store website ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our website.

1. General Conditions

1.1. Acceptance of Terms: By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms. 1.2. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Roanoke County, Virginia. 1.3. Store Information: Merchievo.Store is owned and operated by Merchievo Merchandise Company.

2. Products and Services

2.1. Apparel Focus: Merchievo.Store provides custom and ready-to-wear t-shirts and hoodies. 2.2. Accuracy, Pricing, and Availability: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time. We make every effort to display product colors and images accurately, but we cannot guarantee that your device's display will be accurate. 2.3. Order Cancellation: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person.

3. Custom Design and Intellectual Property (IP) Rights

3.1. Customer Ownership of Content: The customer retains all ownership rights to the designs, logos, text, or content ("Customer Content") they upload to Merchievo.Store for printing. 3.2. Customer Warranty on IP: By submitting Customer Content for printing, you warrant and represent that: * (a) You are the sole owner of the content or have all necessary rights, licenses, and permissions to use and authorize Merchievo.Store to reproduce the content. * (b) The content does not infringe upon any third party's copyrights, trademarks, privacy rights, or other intellectual property rights. * (c) The content is not unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or racially/ethnically objectionable. 3.3. Merchievo. Store’s Right to Refuse: Merchievo.Store reserves the right to refuse to print any Customer Content that it believes, in its sole discretion, violates Section 3.2 or may otherwise be illegal, libelous, or offensive. 3.4. Indemnification for IP: You agree to fully indemnify, defend, and hold harmless Merchievo.Store from any and all claims, liabilities, costs, and expenses (including legal fees) arising from any actual or alleged breach of your warranties in Section 3.2. 3.5. License to Merchievo.Store: By placing a custom order, you grant Merchievo.Store a non-exclusive, transferable, royalty-free license to use, reproduce, and display the Customer Content solely for the purpose of fulfilling your order.

4. Terms of Sale and Payment

4.1. Payment Terms: We accept various forms of payment [Visa, Mastercard, PayPal, Shopify Payments]. You agree to pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred. 4.2. Design Approval (Custom Orders): For custom orders, you will be required to approve a digital proof before production begins. Once approval is confirmed, the design is final, and you accept responsibility for any errors in the approved design. 4.3. Taxes and Fees: You are responsible for all sales taxes, VAT, and customs duties or fees applicable to your purchase.

5. Delivery, Returns, and Refunds

5.1. Shipping Estimates: Any dates quoted for delivery are estimated only, and time for delivery shall not be of the essence. We are not liable for any delay in delivery, however caused. 5.2. Reference to Other Policies: Our policies regarding returns, exchanges, and refunds are governed by our separate Refund and Return Policy, which you agree to upon purchase. 5.3. Risk of Loss: Risk of loss and title for items purchased from Merchievo.Store pass to you upon our delivery to the carrier.

6. Limitation of Liability

6.1. "AS IS" Basis: The Service and all products are provided "as is" and "as available" without any warranty or condition, express or implied. 6.2. Limitation: In no case shall Merchievo.Store, its owner, or its affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

7. User Conduct and Prohibited Use

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others.
