By accessing or using any part of the Merchievo.Store website ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our website.

1. General Conditions

  • 1.1. Acceptance of Terms: By visiting our site and/or purchasing items from us, you engage in our "Service" and agree to be bound by these Terms.

  • 1.2. Governing Law: These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.

  • 1.3. Store Ownership: Merchievo.Store is owned and operated by Merchievo Merchandise Company.

2. Products and Services

  • 2.1. Apparel & Custom Goods: Merchievo.Store provides ready-to-wear and custom apparel, including t-shirts, long sleeves, sweatshirts, hoodies, hats, team uniforms, and workwear.

  • 2.2. Product Accuracy & Display: We make every effort to display product colors, garment specs, and artwork placements as accurately as possible. However, because computer monitors and mobile displays vary, we cannot guarantee that your device's display of any color will be completely exact.

  • 2.3. Pricing & Modifications: Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time without liability.

  • 2.4. Order Refusal & Quantity Limits: We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, household, or order.

3. Custom Artwork & Intellectual Property Rights

  • 3.1. Customer Ownership: You retain full ownership of all logos, graphics, text, and artwork ("Customer Content") that you upload or submit to Merchievo.Store for printing.

  • 3.2. Customer Warranty: By submitting artwork to Merchievo.Store, you warrant and represent that:

    • (a) You are the sole legal owner of the artwork or possess all necessary commercial licenses, trademarks, and permissions to reproduce the content.

    • (b) The artwork does not infringe upon any third party’s intellectual property, copyright, trademark, privacy, or proprietary rights.

    • (c) The content is not defamatory, unlawful, obscene, or threatening.

  • 3.3. Right to Refuse Artwork: Merchievo.Store reserves the right, in its sole discretion, to reject and refund any custom print order containing content that violates third-party intellectual property or is deemed unlawful or discriminatory.

  • 3.4. IP Indemnification: You agree to defend, indemnify, and hold harmless Merchievo Merchandise Company, its owners, and affiliates from and against any claims, liabilities, damages, and legal expenses arising out of any copyright or trademark infringement claim connected to artwork you provided.

  • 3.5. Production License: By submitting artwork, you grant Merchievo.Store a non-exclusive, royalty-free license to use, reproduce, and print the artwork strictly for the purpose of fulfilling your order.

4. Sales, Payment & Custom Approvals

  • 4.1. Payment Terms: We accept major credit cards (Visa, Mastercard, American Express, Discover), PayPal, and Shopify Payments. Payment is required in full prior to order production and fulfillment.

  • 4.2. Proof Approval on Custom Orders: For custom team gear, uniforms, or workwear, a digital mockup proof will be provided. Once you approve the digital proof, the design and layout are considered final. Merchievo is not responsible for spelling errors, layout mistakes, or incorrect sizing explicitly approved by the customer.

  • 4.3. Taxes: You are responsible for all applicable state and local sales taxes calculated at checkout.

5. Fulfillment, Shipping & Risk of Loss

  • 5.1. Shipping Scope: We ship exclusively within the United States.

  • 5.2. Delivery Estimates: All delivery dates provided are estimates and are not guaranteed transit times. Shipping delays caused by postal carriers or severe weather are outside our direct control.

  • 5.3. Risk of Loss: All items purchased from Merchievo.Store are made pursuant to a shipment contract. Title and risk of loss for items pass to you upon our delivery of the package to the carrier (USPS/UPS).

  • 5.4. Return Policy Reference: Returns, exchanges, and cancellations are governed by our separate Refund and Return Policy.

6. Limitation of Liability

  • 6.1. "AS IS" Basis: The Service and all products delivered to you are provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied.

  • 6.2. Liability Cap: In no event shall Merchievo Merchandise Company, its owners, directors, employees, or affiliates be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the site or any products purchased through the Service.

7. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content:

  • (a) For any unlawful or fraudulent purpose;

  • (b) To violate any international, federal, state, or local regulations, rules, or laws;

  • (c) To infringe upon or violate the intellectual property rights of Merchievo or others;

  • (d) To upload viruses, malicious code, or scrape data from the Service.

8. Changes to Terms of Service

We reserve the right to update, replace, or modify any part of these Terms of Service at our discretion. Your continued use of or access to the website following the posting of any changes constitutes binding acceptance of those revisions.
